Airport Basin appeal withdrawn

The appeal of the Planning and Zoning Commission’s approval of the site plan for the Airport Basin Site has been withdrawn, County officials announced late Monday.

William Arland, III, from Rodey, Dickason, Sloan, Akin and Robb, P.A, had filed the appeal last week on behalf of his firm’s client – Cabot, Cabot and Forbes, Los Alamos Investment Company LLC, of Boston, Mass.– regarding the location of the fueling facility on the Airport Basin Site. Cabot, Cabot and Forbes own the property located at 182 East Gate Drive. NSTC is a tenant in the building.

The County Council met Friday to discuss appeal procedures and scheduling of the appeal. At that meeting, County Attorney Mary McInerny advised Council that a phone call on Thursday between Anthony Mortillaro, assistant county administrator, and John Pirovano, president of Old Mountain Company, a member company of the Los Alamos Investment Company, LLC, had resulted in an agreement for the county to provide the fire code provisions concerning the fueling facility location and information concerning the fuel tanks to Pirovano for his engineer’s review.

Pirovano said that if his engineer agreed that the fire codes were met, he would withdraw the filed appeal no later than Monday. Given this new information, Council recessed the meeting to await further news about the appeal.

Mortillaro informed Council today that Pirovano transmitted an e-mail to him before close of business Monday, withdrawing the appeal. The official, signed notification that the appeal has been withdrawn by the Rodey law firm is expected today.

The continuation of the recessed special Council meeting is still scheduled for 5:30 p.m. today in Council Chambers. However, since the appeal has been withdrawn, the meeting will be adjourned.

The first approved phase of the Airport Basin Site Project with Hensel Phelps to complete the site work was approved last month and is scheduled for completion by November.

The next phase of the project will begin this winter for construction of the warehouses, shops, fleet/bus barns, storage yard and buildings for the County and School District’s operations currently housed on Trinity Drive across from Mari-Mac Plaza. The entire project is scheduled for completion by December 2009.
