NOTICE OF SALE NOTICE IS HEREBY GIVEN that pursuant to the Stipulated Judgment, Stipulated In Rem Judgment, Decree of Foreclosure, and Order of Sale entered on September 4, 2014, the undersigned Special Master will sell at public auction, for cash or certified funds, at the hour of 12:00 p.m. (Noon) on October 15, 2014 at the front entrance of the Justice Center, 2500 Trinity Drive, Los Alamos, New Mexico, the real property situated in Los Alamos County, New Mexico described as follows: Tract V-1, of the subdivision of Tract V, Eastern Area No. 2, shown by map or plat thereof filed in the Office of the Clerk of Los Alamos, New Mexico, on the 19th day of October, 1973, and officially of record in Book 2, at page 74, plat records of said county (the property) commonly known as 1315 and 1319 Trinity Drive, Los Alamos, New Mexico 87544 (if there is any discrepancy between the Property address and the legal description, the legal description shall control). The property will be sold subject to the first priority lien of Los Alamos County in the amount of $28,139.02 as of August 14, 2014; and subject to rights of redemption; easements, reservations and restrictions of record; taxes and governmental assessments; any liens or encumbrances not foreclosed in this proceeding; the valuation of the property by the County Assessor as real or personal property; affixture of any mobile or manufactured home to the land; deactivation of title to a mobile or manufactured home on the property; environmental contamination, if any; any association or condominium assessments, declarations, rules, requirements and restrictions; any requirements imposed by city or county ordinance or by state law affecting the property; and zoning violations concerning the property, if any. No representation is made as to the validity of the rights of ingress and egress. Transfer of title to the highest bidder shall be without warranty or representation of any kind. ALL PROSPECTIVE PURCHASERS AT THE SALE ARE ADVISED TO MAKE THEIR OWN EXAMINATION OF TITLE AND TO CONSULT THEIR OWN ATTORNEY BEFORE BIDDING. This action is a suit to foreclose a mortgage secured by the property. The total amount awarded by the Judgment to Los Alamos National Bank, with interest to the date of sale, is $991,344.83, plus its additional costs and attorney fees through the date of sale of the property and any amounts advanced by Los Alamos National Bank to protect its interest in the property before sale, including insurance, maintenance, taxes, assessments or other expenses relating to the property. The proceeds from the judicial sale will be applied first to the payment of the costs and expenses of the sale; then to the payment of the Judgment in favor of Los Alamos National Bank, including additional fees, costs and expenses as stated in the foregoing paragraph. Any excess funds shall be deposited with the Clerk of Court. Los Alamos National Bank may apply all or a portion of its judgment towards the purchase price after satisfaction of the first priority lien of Los Alamos County.
