NOTICE OF SALE NOTICE IS HEREBY GIVEN that pursuant to the Stipulated Judgment of Foreclosure of Real Property entered on September 7, 2016 the undersigned Special Master will sell at public auction, for cash or certified funds, at the hour of 11:00 a.m. on October 17, 2016 at the front entrance of the Justice Center, 2500 Trinity Drive, Los Alamos, New Mexico, the real property situated in Los Alamos County, New Mexico described as follows: Lot 92, Barranca Mesa Subdivision No. 1, as shown on the corrected subdivision plat thereof filed for record on June 9, 1958, in Plat Book 1, Page 2, records of Los Alamos County, New Mexico (the "Property") located at 232 Andanada Street, Los Alamos, New Mexico 87544 (if there is any discrepancy between the Property address and the legal description, the legal description shall control). The Property will be sold subject to a one month right of redemption. Any purchaser or purchasers at the sale shall take title to the Property subject to all encumbrances and taxes not foreclosed by the Judgment, including easements, reservations and restrictions of record; taxes and governmental assessments including unpaid utility bills; any liens or encumbrances not foreclosed in this proceeding; the valuation of the Property by the County Assessor as real or personal property; affixture of any mobile or manufactured home to the land; deactivation of title to a mobile or manufactured home on the Property; environmental contamination, if any; any homeowners' association or condominium dues, assessments, declarations, rules, requirements and restrictions; any requirements imposed by city or county ordinance or by state law affecting the Property; and zoning violations concerning the Property, if any. No representation is made as to the validity of the rights of ingress and egress. Transfer of title to the highest bidder shall be without warranty or representation of any kind. ALL PROSPECTIVE PURCHASERS AT THE SALE ARE ADVISED TO MAKE THEIR OWN EXAMINATION OF TITLE AND TO CONSULT THEIR OWN ATTORNEY BEFORE BIDDING. This action is a suit to foreclose mortgages in favor of Los Alamos National Bank secured by the Property. The total amount awarded by the Judgment to Los Alamos National Bank, with interest to the date of sale, is $363,040.59, plus its additional costs and attorney fees through the date of sale of the Property and any amounts advanced by Los Alamos National Bank to protect its interest in the property before sale, including insurance, maintenance, taxes, assessments or other expenses relating to the Property. The proceeds from the judicial sale will be applied first to the payment of the costs and expenses of the sale; then to the payment of any costs incurred by Los Alamos National Bank or the Court for the maintenance and protection of the Property; then to the payment of the Judgment in favor of Los Alamos National Bank, including additional fees, costs and expenses as stated in the foregoing paragraph. Any excess funds shall be deposited with the Clerk of Court to be applied as may be determined by the Court. At the sale Los Alamos National Bank may apply by bid all or a portion of the amount of its Judgment towards the purchase and may be credited for the same at the sale as if the same were cash.
